1. About These Terms

These Terms of Use ("Terms") are an agreement between you and Sonderlynd ("Company," "we," "us," or "our"). They apply when you visit any of our websites, buy a product or ticket, book a session, make a donation, join a group, take part in a production, or otherwise use anything we offer.

By using our websites or services, you agree to these Terms. If you don't agree, please don't use them.

2. Who We Are

Sonderlynd is a for-profit business based at 401 N Broadway, Fergus Falls, MN 56537. These Terms cover Sonderlynd and all of its brands:

• Alexander's Playhouse: a community black box theater in the round (alexandersplayhouse.sonderlynd.com)
• Skyfisher Studios: an independent film company (skyfisherstudios.sonderlynd.com)
• Living Arts Press: scripts, production kits, workbooks, and other resources for all Sonderlynd brands (livingartspress.sonderlynd.com)
• Ides Portrait: portrait and wedding photography (idesportrait.sonderlynd.com)
• Moms of Women in Crisis: a peer-support community for mothers of teen and adult women in crisis (momsofwomenincrisis.sonderlynd.com)

When these Terms say "our websites," they mean sonderlynd.com and every brand website listed above.

3. Who May Use Our Services

You must be at least 18 years old to buy from us, book a session, make a donation, or agree to these Terms. A person under 18 may take part in our productions, sessions, or programs only with the permission of a parent or guardian, who agrees to these Terms on the minor's behalf.

Moms of Women in Crisis groups and events are for adults 18 and older.

4. Related Policies

These policies are part of these Terms:

• Privacy Policy: how we collect, use, protect, and delete your information.
• Refund Policy: refunds, exchanges, deposits, and cancellations for every brand.
• AI Use Policy and AI Disclaimer: when and how we use AI tools.
• Code of Conduct: how we expect everyone in our spaces, groups, and productions to treat one another.
• Child Safeguarding Standards: how we protect minors in our care.

Some activities also have their own written agreements, such as participation forms, media releases, film releases, safety waivers, and wedding contracts. If one of those agreements conflicts with these Terms, the signed agreement controls for that activity.

5. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the new version on our websites and change the "Last Updated" date above. Changes apply from that date forward and do not change the terms of a purchase you have already made.

6. Purchases and Payments

Prices. All prices are in U.S. dollars. Before you pay, we show the total price, including every fee you must pay to complete the purchase. Sales tax, where it applies, is added at checkout.

Payment. Online payments are processed securely by Stripe. We never see or store your full card number. When we accept a check, we use it only to deposit your payment. We do not copy or store check images or banking details.

Mistakes. If a product, ticket, or service is listed at the wrong price because of an error, we may cancel the order and refund you in full, or offer it to you at the correct price.

Refunds. Refunds, exchanges, and cancellations are covered by our Refund Policy.

7. Digital Products

Living Arts Press products are delivered digitally, usually by email or by a download link at checkout. Please download and save your files when you receive them. If a link doesn't work or you receive the wrong file, contact us and we will send working files, as described in our Refund Policy.

Every digital product comes with a license, described in Section 10. You are buying a license to use the product, not ownership of it.

8. Tickets, Bookings, and Events

Tickets. Tickets for Alexander's Playhouse performances are held at Will Call. We release tickets to the person who presents the receipt. Tickets not claimed by the end of the performance are forfeited.

Portrait sessions and weddings. Ides Portrait sessions are confirmed when booked. Weddings are confirmed in writing once the deposit is paid. Galleries are released after payment in full. Wedding clients also sign a separate contract, which controls if it conflicts with these Terms.

Events. Each event lists its own refund terms, age requirement, and accessibility contact before registration opens.

9. Donations

Sonderlynd is a for-profit business, not a charity. Donations to Sonderlynd or any of its brands, including Moms of Women in Crisis, are not tax-deductible and are non-refundable. Our donation receipts confirm the amount you gave. They do not suggest that your gift is tax-deductible.

10. Our Content and Your License

Ownership. Our scripts, production kits, workbooks, devotionals, guides, printables, films, photographs, videos, logos, brand names, and website content are owned by Sonderlynd or the people who licensed them to us. They are protected by copyright and trademark law. Unless these Terms or a written agreement say otherwise, you may not copy, change, share, sell, or publicly display them.

Personal-use license. Workbooks, devotionals, guides, planners, printables, phone wallpapers, and other resources come with a personal-use license. This license lets you:

• Download the files and keep backup copies for yourself.
• Print as many copies as you need for yourself and your household.
• Use printables and wallpapers on your own devices and in your own home.

It does not let you:

• Share, email, post, or upload the files for others to use.
• Resell, sublicense, or give away the files, in whole or in part.
• Use the files in a class, group, or business without our written permission.
• Remove our name or copyright notices.
• Enter the files into an AI tool to copy them, create competing products, or train an AI model.

Performance license. Every script and production kit comes with a performance license. The license is described on the product page and in the product files, and it includes:

• The number of productions and performances it covers. [CONFIRM: for example, one production by one group, with unlimited performances during that run.]
• The required credit line, which must appear in every program and in promotional materials.
• What may not be changed without written permission, including the title, dialogue, and story.
• A limit on recording, streaming, or broadcasting performances without written permission.

Permission requests. To ask for permission beyond your license, such as rewriting dialogue, streaming a performance, or using a resource with a group, email livingartspress@sonderlynd.com. We will give you a written answer within 10 business days. A permission is valid only if we give it in writing.

Films. Skyfisher Studios films are for personal viewing unless you have a written screening or distribution agreement with us.

Photographs. Ides Portrait clients receive a personal-use print release, described in Section 13.

Copyright concerns. If you believe something on our websites uses your work without permission, email info@sonderlynd.com. Include a description of the work, where it appears on our websites, and how to reach you. We will review it and respond promptly.

11. Alexander's Playhouse

• Photography and recording. Photography, video, and audio recording are not allowed during performances. We may ask anyone recording to stop or to leave.
• Late arrivals. Latecomers are seated in the back at a suitable moment, so the performance is not interrupted.
• Age guidance. We publish age guidance for each show before tickets go on sale. Parents and guardians decide whether a show is right for their child.
• Performers. Cast and crew sign participation forms, media releases, safety waivers, and a written compensation agreement before the first rehearsal. A parent or guardian signs for every minor.
• Headshots. We may use AI tools to give cast headshots a matching background, lighting, and framing. We never alter facial features. Cast members, and parents or guardians of cast members under 18, consent to this in the media release. Programs note when headshots have been digitally edited.

12. Skyfisher Studios

• Releases. Everyone who appears in or works on a Skyfisher Studios film signs a release before filming begins. That release controls how the film and recordings may be used.
• Likeness. We will never create an AI replica of a performer's face or voice without their written consent and payment. We never use AI-generated performers in our films.
• Screenings. Screenings and festival showings may have their own ticket and admission terms, which are posted with the event.

13. Ides Portrait

• Image restrictions. At booking, we ask whether your images may be shared on social media or in marketing, and whether any restrictions apply. We honor every restriction without asking why.
• Minors. A parent or guardian attends every session with a minor. For a senior session without a parent present, we need written permission from a parent or guardian, and we tell them the time and location.
• Weather. We may reschedule outdoor sessions because of weather. We will contact you before the session if this happens.
• Editing. We edit images as described in our AI Use Policy. We never change your body shape or identity, add or remove people, or create images that weren't taken at your session, unless you ask us to in writing.
• Galleries. Your online gallery is available for 1 year after delivery. Please download your images during that time.
• Copyright and print release. The photographer keeps the copyright in all images. You receive a personal-use print release, which lets you print and share your images for personal, non-commercial use. Please credit Ides Portrait when you post them. Using images for commercial purposes, contests, or publications requires our written permission. [CONFIRM: whether clients may apply their own filters or edits.]

14. Moms of Women in Crisis

• Peer support only. Moms of Women in Crisis offers peer support from mothers with lived experience. It is not counseling, therapy, medical care, legal advice, or a crisis service. Nothing shared in our groups, resources, or messages is professional advice.
• In a crisis. If you or someone else is in danger, call or text 988 (the Suicide and Crisis Lifeline), or call 911 in an emergency.
• Membership. Groups and events are for adults 18 and older. Every member agrees to the group guidelines in our Code of Conduct.
• Protecting daughters. Members may not post the name, photo, school, or other identifying details of a daughter under 18. We remove posts that do.
• Protecting each other. Members may not share another member's story, screenshots of the group, or private messages outside the group. Members may not sell, recruit, or give medical or legal advice.
• Human replies only. A person reads and answers every support message. We never use AI tools to read, summarize, or answer support messages, posts, or stories.
• Sharing your story. We publish a mom's story only with her written consent, describing where it will appear and whether her name will be used. She approves the final version before it is published and may ask us to remove it at any time. We remove it within 24 hours.

15. Content You Share With Us

When you send us a story, comment, post, photo, review, or message, you keep ownership of it. You give us permission to use it only in the ways you agree to in writing, such as a story-sharing consent or a media release. You confirm that you have the right to share what you send.

We may remove any content from our websites, social media, or groups that breaks these Terms or our Code of Conduct.

16. Acceptable Use

When you use our websites and services, you agree not to:

• Break any law, or help someone else break one.
• Harass, threaten, shame, or harm anyone.
• Share anyone's private information, images, or story without their permission.
• Pretend to be someone else, or misrepresent your connection to anyone.
• Copy, scrape, or collect content or information from our websites by automated means, including to train AI models.
• Upload viruses or harmful code, or try to get into accounts, systems, or files you're not allowed to access.
• Use our websites, groups, or events to sell, advertise, or recruit without our written permission.

We may refuse service, cancel orders, or remove someone from a group, event, or production if they break these Terms or our Code of Conduct.

17. Other Services

Our websites may link to, or rely on, services we don't control, such as Stripe, email providers, and social media platforms. Those services have their own terms and privacy policies. We are not responsible for their content or practices.

18. Educational Content and No Professional Advice

Our resources are for education, encouragement, and creative growth. They are not professional, medical, mental health, legal, or financial advice. Results depend on many things outside our control, and we don't promise any particular result. How you use our scripts, production kits, workbooks, and other materials is your responsibility.

19. Disclaimer

We work hard to make everything we offer accurate, useful, and safe. Still, to the fullest extent allowed by law, our websites, products, and services are provided "as is" and "as available," without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that our websites will always be available or free of errors.

Nothing in these Terms limits any rights you have under law that cannot be waived.

20. Limitation of Liability

To the fullest extent allowed by law, Sonderlynd and its owner, staff, volunteers, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of our websites, products, or services.

To the fullest extent allowed by law, our total liability for any claim is limited to the amount you paid us for the product or service the claim is about, in the 12 months before the claim arose.

This section does not limit liability for our gross negligence or willful misconduct, or any liability that cannot be limited by law.

21. Indemnification

You agree to defend and hold harmless Sonderlynd and its owner, staff, volunteers, and contractors from claims, losses, and costs (including reasonable attorneys' fees) that arise from your breaking these Terms, misusing our content, or violating someone else's rights.

22. Resolving Disputes

If you have a concern, please contact us first at info@sonderlynd.com. Most problems can be solved quickly and kindly. If we can't resolve a dispute informally within 30 days, either of us may bring a claim.

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law rules. Any claim must be brought in the state courts located in Otter Tail County, Minnesota, or in the United States District Court for the District of Minnesota. Either of us may bring an eligible claim in small claims court (conciliation court) instead.

23. General Terms

• Entire agreement. These Terms, the policies listed in Section 4, and any signed agreement for a specific activity are the entire agreement between you and us.
• Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
• No waiver. If we don't enforce part of these Terms right away, we can still enforce it later.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours if Sonderlynd or one of its brands is sold or reorganized.
• Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, illness, power outages, or public emergencies. Our Refund Policy explains what happens if we cancel or postpone a performance or event.
